Ecological environment monitoring is a crucial foundation for strengthening ecological protection and implementing environmental management. The State Council recently promulgated the "Regulations on Ecological Environment Monitoring" (hereinafter referred to as the "Regulations"), which will take effect on January 1, 2026.

As China's first comprehensive administrative regulation in ecological environment monitoring, the Regulations establish strict legal liabilities to strengthen government-led public monitoring, standardize self-monitoring by enterprises and institutions, regulate technical service providers' commissioned monitoring services, and define the responsibilities of various entities. This marks a new phase of legal and standardized governance in ecological environment monitoring.

Establishing a registration system for monitoring sites and promoting a nationally unified monitoring network

In recent years, China's ecological environment monitoring has achieved remarkable progress, establishing the world's largest national ecological environment quality monitoring network with comprehensive coverage, scientifically rational layout, and relatively advanced technical means. However, challenges remain, including inadequate integration of monitoring data, redundant infrastructure, and regulatory blind spots. To address these issues, the Regulation explicitly requires the establishment of a monitoring network featuring rational layout, complete functions, hierarchical classification, and collaborative sharing, while promoting interconnectivity between national and local monitoring systems.

At the implementation level, the Regulations establish a filing system for monitoring station establishment. Provincial, autonomous regional, and municipal ecological environment authorities are required to uniformly plan the deployment of local ecological environment quality monitoring stations within their jurisdictions, with all station setups, adjustments, and closures subject to filing with the State Council's ecological environment department or relevant authorities. This integrated approach of unified planning and filing management ensures a rational, standardized, and orderly national ecological environment monitoring network, facilitating the development of a comprehensive monitoring framework.

Establish a monitoring data quality management system, failure to establish may face a maximum penalty of 200,000 yuan

The authenticity and accuracy of self-monitoring data from enterprises and institutions are crucial to the effectiveness of pollution reduction and the improvement of environmental quality. The Regulation has implemented a comprehensive set of measures to ensure strict prevention at the source for these entities.

For the first time at the administrative regulation level, six specific categories of data falsification behaviors are detailed, including:

(1) issuing monitoring reports without actual monitoring;

(2) tampering with or forging original monitoring records and data;

(3) intentionally omitting monitoring items or altering monitoring conditions;

(4) swapping monitoring samples or unauthorized changes to sampling locations or times, thereby interfering with sampling environments or activities; (5) causing data distortion through improper operation, equipment damage, unauthorized parameter modifications, false labeling of automatic monitoring equipment or production facilities, or the use of cheating tools;

(6)and other acts of data falsification.

At the same time, it is clearly required that enterprises and institutions establish a monitoring data quality management system, and must strengthen the whole process management of sampling, analysis, recording, audit and other activities. Enterprises and institutions that do not set up a quality management system will be fined 20,000-200,000 yuan.

The Regulations establish a comprehensive regulatory framework for monitoring equipment management, covering the entire lifecycle from production to use. They mandate that enterprises and institutions employ monitoring devices compliant with national standards and specifications. Furthermore, the regulations stipulate that environmental authorities may publicly disclose information about manufacturers and sellers of substandard monitoring equipment, while referring such cases to market supervision departments for enforcement. Producers and sellers will face legal penalties, effectively curbing the use of non-compliant equipment at its source.

The Regulations on the Double Penalty System and the Prohibition of Employment for the Falsification Institutions and Individuals

Technical service providers are key players in the ecological environment monitoring market, where their professional standards directly determine data reliability. To tackle the industry's issues of being' small, fragmented, and disorganized,' the Regulation mandates a comprehensive service traceability system. This framework establishes a robust oversight mechanism-from institutional registration and professional compliance to accountability-thereby reshaping the monitoring market into a healthier ecosystem.

The "dual penalty system" and professional ban provisions represent a groundbreaking innovation. For technical service providers engaged in data falsification, not only are the institutions subject to heavy fines, but the directly responsible individuals are also banned from the industry for periods ranging from 5 to 10 years or even for life. This dual accountability mechanism, which equally emphasizes personal and institutional responsibility, has effectively curbed the practices of some technical service providers who attempt to "escape the net" or "switch jobs after each offense."

The Regulations require technical service institutions to possess corresponding facilities, equipment, technical capabilities, personnel, and management capacity, and to register with the competent ecological environment authorities. This filing system establishes basic entry thresholds while avoiding excessive administrative approvals that could stifle market vitality. Additionally, registered institutions must submit written commitments and take responsibility for their authenticity, thereby strengthening institutional self-discipline and social oversight.

Introduce technical means such as process monitoring to further improve the efficiency of supervision

In terms of innovative regulatory approaches, the Regulations set clear objectives for establishing a modern monitoring system, aiming to build a high-level ecological environment monitoring network that covers both land and sea, integrates space and ground, coordinates central and local authorities, and ensures data interoperability. This initiative drives the advancement of ecological environment monitoring technologies and equipment towards automation, digitization, and intelligentization.

The Regulation introduces an innovative "electronic surveillance system" for process monitoring. It mandates the installation of video surveillance equipment at key monitoring sites to capture real-time monitoring activities and equipment operations, with these systems connected to environmental authorities. This enables real-time monitoring of ecological conditions and pollution sources, precise source tracing, and trend-based early warnings, thereby enhancing regulatory transparency and effectiveness.

The Regulations explicitly promote intelligent supervision and remote monitoring. They encourage the development and application of advanced ecological environment monitoring technologies and equipment, driving the deep integration of IoT modules, data encryption, and tamper-proof technologies with traditional monitoring devices. By utilizing non-contact methods such as remote inspections and remote sensing monitoring, along with video surveillance, IoT, and big data analytics, the efficiency of regulatory oversight is significantly enhanced.

Establish a credit evaluation system for ecological environment monitoring. The Regulations require implementing tiered and categorized precise supervision over technical service institutions, reducing inspection frequency for those with good credit and strong capabilities, while intensifying oversight for high-risk entities.

The Regulations systematically address the challenges and pain points in current management practices, establishing a new pattern of ecological and environmental monitoring with clear rights and responsibilities, strong constraints, standardized behavior, and efficient operations. It not only strengthens the leading role of the government and reinforces the primary responsibility of enterprises and institutions, but also standardizes the order of the technical service market. By clarifying the rights and responsibilities of all parties, innovating regulatory methods, and increasing penalties, the credibility of ecological and environmental monitoring data has been further enhanced, providing a solid legal guarantee for the in-depth advancement of ecological civilization construction and the building of a beautiful China.
